Contents of the workshops and individual coaching sessions

Registration for Workshops
The binding registration is made by sending an email to “info@discoverkinbaku.com“. Expressions of interest in social media are not effective. Places will be allocated after receipt of applications. There is no right to participation. Registrations are binding. With the sending of the confirmation of registration and the invoice, the contract for the participation in the seminar is considered concluded. The participation fee is due immediately without deductions upon receipt of the confirmation of participation.

Payment

The course fees are inclusive of taxes and duties. Payments are processed by us, if necessary with the support of a payment service provider. Bank transfer or PayPal are available. For this purpose we, or the payment service provider PayPal, require certain personal information from you. This is your name and address, account number and bank code or credit card number (including validity period), invoice amount and currency as well as the transaction number. PayPal may use and disclose this information to us for payment processing purposes. We are required to treat the information in accordance with German data protection laws.
Legal right of revocationThe participant may revoke his contractual declaration in writing (e.g. letter, e-mail) within 14 days without stating reasons. The period begins after receipt of this instruction in text form, but not before conclusion of the contract and also not before fulfilment of our duties to inform according to article 246 § 2 in connection with § 1 paragraph 1 and 2 EGBGB as well as our duties according to § 312g paragraph 1 sentence 1 BGB in connection with article 246 § 3 EGBGB. The timely dispatch of the revocation is sufficient to comply with the revocation period.

Exclusion of the right of revocation

The right of revocation for consumers does not exist or may expire prematurely in the case of contracts for the provision of services in the areas of accommodation for purposes other than for residential purposes, transport of goods, motor vehicle rental, delivery of food and beverages as well as for the provision of further services in connection with leisure activities, if the contract provides for a specific date or period for the provision, § 312g paragraph 2 No. 9 BGB. Booked workshops or seminars with fixed dates are therefore binding immediately after confirmation by the organiser and oblige the participant to attend and pay the seminar fee.

In addition, the participant may cancel an already booked coaching or seminar under the following conditions:

  • Up to 6 weeks before the booked date: The full course fee will be refunded in the form of a voucher.
  • Up to 14 days before the booked date: 50% of the course fee will be refunded in the form of a voucher.
  • 7 days before the booked date: there will be no refund.

There is generally no refund beyond the statutory period for promotional tickets.

The payment of a voucher credit is not possible. The participants have the possibility at any time free of charge to nominate substitute participants for booked offers in which they cannot participate.

Cancellation

We reserve the right to cancel a workshop at short notice, if the minimum number of participants according to the performance description is not reached, or if the trainer is prevented by illness, accident or other circumstances of force majeure and no suitable substitute trainer is available. The participant then receives the participation fee back without any deductions, but is not entitled to any reimbursement of travel or accommodation costs.

Liability of the organiser for workshops and individual coaching

The organiser is liable exclusively within the scope of its liability insurance in accordance with the statutory provisions for personal injury, property damage and financial loss caused by the organiser or a person entrusted with the management of the event. Apart from legal liability, participation is at one’s own risk. The legal principle of personal responsibility applies. The organiser’s instructions must be followed.

Special illnesses or impairments must be reported to the organiser before the start of the course. Should it turn out that the participant, in spite of illness or impairment, knowingly provided no, only incomplete or false information and this leads to problems, he can be excluded from the course – without reimbursement of the paid course fee.

Participation in course contents that contain a potential risk is voluntary (e.g. suspension exercises). All liability obligations on the part of the organiser shall lapse if alcohol, drugs or other intoxicants are in direct or indirect connection with damage to participants, third parties or material assets concerned. The organiser is not liable for damages caused by the use of the participants own tools.

Copyrights as well as photo and video recordings

All seminar documents are protected by copyright and are for the personal use of the participants only. Any video and audio recordings, duplication and publication of event documents as well as their transfer to third parties or other use is only permitted with our prior written consent. 

Data protection

All participants’ data will be treated confidentially and used only in accordance with the data protection regulations of the Federal Republic of Germany and the DSGVO.
Participants’ data will be stored for the purpose of billing and service provision and will only be passed on to service providers commissioned for this purpose if necessary for this purpose.

Salvator clause 

Verbal collateral agreements have not been made. Changes to the contract must be made in writing. Should any provision of this agreement be invalid, this shall not affect the validity of the remaining provisions. The ineffective provision shall be replaced by another provision which is effective and which comes closest to the content and purpose of the ineffective provision to the extent permitted by law.

We reserve the right to correct errors, printing errors and miscalculations.

The place of jurisdiction for all legal actions against the organiser as well as against the customer is always Berlin.

With the registration the participant accepts the terms and conditions.
